this settlement is redefine what is our maintenance obligation going forward. we redefined it based on existing conditions together with the scope of work that the 49ers are going to complete now and existing funding levels that we are currently funding the maintenance of the stadium. rather than the existing dispute, which has been whether or not we are maintaining and in good condition in accordance with nfl standards and some maintenance manuals, we defined the maintenance obligation as existing conditions. the other thing we have done is we have a very broad release of all claims related to the existing condition of the stadium with a car around for any potential third-party claims. if a third party is injured in the stadium, that is still something we will be on the hope for, but the team no longer has the right to sue us based on the condition of the stadium. the settlement involves a lease amendment, and both the settlement and lee's government,
as i mentioned, will go to the board of supervisors for approval. relevant terms are that we change the term of the lease, which currently is until 2013 with two five-year extension options. we have amended it to continue the lease currently through 2016. so they are currently exercising an option for a couple of years, and we amended the remaining extension options as just one- year options they can exercise in two years prior notice. we also gave them the right to terminate in 2015 if they chose to do so. we have a $3 million payment issued for stadium improvements. we have listed what those improvements are as part of the lease amendment. that money is going to come out of the city's litigation reserve and not out of the department's budget. we have granted them some credits and rent reductions going forward. those reductions and credits have been strategically designed
to maintain the current flow of funding that the department currently receives from the team under its lease. in the past, we have given various credits, and i think the department -- katie is not here, but she can describe the actual amount of revenue, but it is the same as what we have been receiving for the past three or four years after deducting existing rent credits. we also included provisions with regard to unanticipated capital repairs. and what happens in the event that there are significant unanticipated capital repairs needed in the stadium. in that case, we would continue to go to arbitration, like under the current lease, and we preserve all of our rights and remedies that currently exists, with respect to whether or not we would have to do repairs based on a panel where an arbiter would decide. the last piece -- we have two
things of lesser importance, but we specifically contemplated the possibility that these may be shortened, and as you know, i think there's some question about the next season. we have agreed that rent credits and rent reductions we have given them would not apply in the event of a shortened season. we change the parking fee so that they would increase from what is currently $25 to $30, and that is -- they do pay rent based on the amount of parking revenue, so that is an origin of increased revenue to the department. with that, i'm happy to answer any questions you may have about this. >> the shortened season part of it -- what are the implications again? i did not follow completely. >> what we have done is said, "you get rid credit -- rent

anyone to make a presentation on item 8? >> would you like to go to item 9 and we come back to that? commissioner buell: did we advise item is that we were going to meet at 10:00 in the morning? item nine. >> item 9 is doyle drive project, and accept and expend a grant. >> good morning, commissioners. i am with the capital division. the item before you today is discussion and possible action to accept and expend a grant administered by the san francisco county transportation authority for the presidio park would project in an amount of up to $1 million. we came before you in december,
as you will recall. the strategies are temporary, to be implemented while it is under construction, and it will be restored back to its existing condition at the conclusion of the project in mid-2014. the funding was approved by the authority. the strategies developed to assist the palace of fine arts theater at exploratory m., who are our attendance, to help minimize parking overflow into adjacent neighborhoods. i will be happy to answer any questions you have. commissioner harrison: he talks about the improvements that are going to be made, the changes. as mentioned, driveway modifications i am a little confused on. what does that mean? >> the drive with modifications
noted there are modifications to the driveway to the lot when it is put back on line in mid-2011. those are just curve modifications. if you recall, as part of our presentation in december, the lot will be brought back online after it is reconstructed, where we gain about 62 parking spaces. that is that the little island? i thought that was not included? >> no, no. we are talking about the lehr lot. >> the triangle was eliminated. we do not have a big crowd here today. closed. commissioner buell: 90 very much. it is in the hands of the commission. moved and seconded. all those in favor? opposed? hearing none. thank you very much. it is unanimous. >> we are on item 10, the community opportunity fund. >> good morning, commissioners. i wanted to give you a brief update and answer any questions you have about the revisions to the implementation plan, and the project selection criteria for the community opportunity fund. in brief, i do not think any of these will be a surprise to you. the menu component to the program -- we are proposing to suspend the foreground two. as mentioned in december, it was generally pretty unpopular in the first round. it was initially intended to support small projects, and we found that several small projects are actually funded through the customs program, and i think that speaks to the unique nature of a lot of our
parks. there is one other relatively minor policy program change we are proposing -- that neighborhood parks funded by the bond in other ways are no longer eligible. this came up with a couple of applications, and that really speaks to the balance and intent of the opportunity fund, balancing the geographic distribution of funds across the city. as to the revisions to the criteria in the implication plan, we really were just looking at removing some redundancies and making the point seem more equitable for the program. we made more specific revisions in the selection process, and as commissioner harrison can attest, this was something we could attest to it at the committee, the giving committee members the ability to ask questions of the applicants was something we thought was very important, but within a specific time frame, because it is our goal to deliver these projects, so i will be administering that
throughout the process. as to the application, it is always a challenge with the pilot round of anything. we are really struggling with knowing what to ask before we knew exactly what we needed. we made some revisions to the application process. primarily with an additional form that separates out the stewardship of a group and their commitment and recognizing that financially, separating that out from the project. there is a really distinct project budget, and we know exactly what we are getting into moving forward. it sort of became an arithmetic problem for me during the application process, and i'm looking forward to streamlining that and working with groups on the front end. the other big thing we are doing, and this is really in recreation of bill, it part stored and project selection committee member, who has been totally instrumental in the success of the program at this point -- he suggested going paperless with the application process for the second round. there was one group last round that spent $300 just in
developing the graphics for their application. so i have all of the files in digital spreadsheet files, but also in an open document source format so they can use a free spreadsheet reader to prepare their applications. i also wanted to mention that we are beginning -- we are scheduled to begin our applicant workshops next week. there is about 130 people in groups right now on the mailing list for the program. we are expecting great response to the second round. commissioner buell: thank you. public comment, i think. excuse me, let's get commissioner lee. commissioner lee: i understand the item was not placed in front of capital because of time restraints, but in the future, capital items if all possible
should be placed in the capital committee first before going to the full committee. with that said, i was wondering what kind of out -- you are doing in terms of language, materials -- what kind of outreach you are doing in other languages to let people know about the opportunities and what kind of responses you have gotten. >> we have been primarily working with the board of supervisors. we have not received any requests for translation services, but i am certainly prepared to begin that as soon as possible. and i can translate the documents, if you think that is important. commissioner lee: that might be something we could look at. >> absolutely. in the first round on this, i sat on this committee. there were a few minor things that changed -- prompted these changes that dick is putting forward. i think they are important and i
think there would be helpful if instituted. it is a nice program, seeing some good results, i believe. we have a good man sharing our group. >> thank you. >> we do have public comment. victoria bell. >> good morning, commissioners. neighborhood parks council. i just want to endorse what date has been working on, the neighborhood parks council, to support the up to the implementation plan and new reflection criteria. we are appreciative of the ongoing partnership and we have been following all of the progress of the groups we have been working with, following a successful first round. we have seen the renewed enthusiasm with the department's work with. that interest has encouraged us

>> good afternoon, commissioners. nicole avril. i am quite pleased to present to you today one of our most wonderful properties and partnerships for the department, of which most of us do not know about. commissioner bosnia remembers when it was presented in 2004 initially. >> and it is right in my neighborhood. i cannot wait until that happens. >> it is the geneva car barn and power house located in district 11. the car barn and our house was designed by the reed brothers, best known for the fairmont hotel. it served as a depot for the san michaele united san francisco and market street railways and
the san francisco municipal railway. it is the last fiscal reminder of the electric railway. in 1985, it was declared a city landmark. following the loma padilla earthquake, the building was left to deteriorate. in 1998, muni announced plans to demolish the structure and put a parking lot in its place. to halt the demolition plans, friends of the geneva car barn and our house was established, and formed a neighborhood citizens group. in 1999, we then initiated the stabilization plan for the building. under the leadership of then general manager goldstein, in march 2004, the ownership of the building was transferred from muni to the recreation and parks department. the group developed a specific program for adaptive reuse on
the building based on the award winning gallery 37. calory 37 was designed to create a way to educate. 260 apprentice artists for six weeks. it has grown to provide 4000 employment positions in programs that operate year round. richard daley has identified gallery 37 as one of his administration's most successful programs, and in recognition of the success, in guidelines to develop programs elsewhere, and has been duplicated in 15 cities across the country. the university of chicago issue brief determined that students to present it in the program missed fewer days of school, failed a significantly lower percentage of their classis, and had higher graduation rates. research indicates the trend in
business planning -- placing a greater emphasis on creativity. a nonprofit board represents 2000 of the world's largest companies and their report stimulation, ought to pinochet are among the top-10 concerns and that our study and experience are some of the top factors in the workforce. in 2004, stabilization of the building was completed. elements included a new roof, only the second in the building's history, repair of the seismic reinforcement. under district 11 supervisors, the car barn has received $350,000 from the city to support the rehabilitation, and in 2008, received $200,000 from the recreation and parks department. the supervisor and recognize the need that may barn has said mta in this district, across the
street from one of the busiest transportation hubs in the city. district 11 is a diverse area of the dominant late asian and hispanic persons. the district is primarily non english speaking with the city's largest congolese speaking community. it is the lowest per and come. 71% of residents have earned less than a college degree and is the only district in san francisco where the majority of residents are foreign born. most importantly, it is home to the greatest you ages 10 to 19 but has the lowest percentage of youth services in the city. a study looking at what residents desired ranked teenager and after-school programs the highest in any in the city. residents also placed a strong emphasis -- emphasis on cultural activity. there are no dedicated theater
or gallery spaces in the area. in 2010, the cards are received its national historic landmark status, the only building in the district with this designation. in national historic trust consider is an adaptive use for buildings as a new investment. in a similar vein, the standards as the development council developed a plan for the area for the bubble park station, and includes the car barn as an anger for the entire neighborhood. the board of supervisors unanimously approved the plan in 2009. the guidelines state the synergy between the car and surrounding blue-collar neighborhoods can help to create a new town center around a transit center and points out that the proximity to excellent service should be realized to the fullest extent. i want to sum it up by talking
about some of the initiatives. as part of the effort to prevent the demolition, many are on record as supporters of the project, new mission improvement association, neighbors of the excelsior, san francisco heritage association, a coalition of san francisco neighborhoods, excelsior district improvement association, san francisco beautiful. san francisco youth commission, director of the mayor's office, director of the mayor's office of economic and workforce development, director of the san francisco arts commission. in addition, several partners have expressed strong support for the project by providing pro bono services. our primary partners are the following -- they will be presenting the building design later in the
meeting. they went out and met with every community partner who will be participating in the building as well as other constituents to determine how to best use the space. we are also working with legal representation and oversight of -- who are providing legal representation and oversight of the tax process. we are working with mary murphy who has done this before. we are also working with them to create an mou between the car barn and the department, which we modeled after the old men's. technical arts studio space. oliver and co. construction.
they provided cost estimation. before i some on my part of the presentation, among to express my thanks to the friends of the gm car barn and staff in their efforts to rehabilitate the building. this will allow the department to increase resources to population that need them most and save buildings. i would now like to introduce the executive director of the geneva car barn and our house. >> first of all, -- >> could you speak into the microphone? >> first of all, i want to thank the commission for this opportunity to present the geneva car and power house. i also want to thank the call who has been a significant asset to our project, in her role with iraq and park, and previously as executive director of the geneva car barn and our house project. by way of introduction, i would
like to introduce myself. i grew up in visitation valley. i know the car barn and district 11 very well. oftentimes, start of classes when working with young people -- i grew up in the valley but i was not one of those kids that slapped on the corner in the valley. i was one of those kids trying to make my way past those kids that were simply standing on the corner. oftentimes, where i was trying to make my way too, was often to a place of what we envision the new geneva car barn and powerhouse to be. so with that, i want to give you some highlights on some of the programming that has been happening at the car barn in the past few years and demonstrate some of the bible models we developed and also the desire on the park with young people and communities to support the projects such as this.
as some of you may know, and has been mentioned, in 2009, there was a ramping up of development for the geneva car barn and powerhouse project. is included not only the development sites, but also the development of arts and cultural programs. as nicole mentioned, there were many discussions in the community with residents and community organizations. what surfaced was a priority. that priority was for you. in particular, we looked at the development of programs that would provide enrichment opportunities, the employment opportunities, and opportunities for young people to creatively express themselves through the arts. so with that, in the summer of 2010, we launched the powerhouse arts project, a project that focuses on four different disciplines, media, literary,
culinary, technical and design parts, for young people between the ages of 14 and 17. we were able to get funding through the department of children and families to provide wages and stipends for young people participating in those programs. we worked with a number of leading arts organizations throughout the city to provide instructors, artists, access to unique facilities throughout this facility, such as museums and galleries for our young people, who would otherwise might not have access to any of this. you are going to hear a little bit about the building later in the presentation, but suffice it to say, when the building is fully realized, it will be a one-of-a-kind facility in the district, perhaps in the city. it will feature a theater, an
exhibition in performance space, retail spaces, cafes, and spaces for classes to happen. even in this period, we are beginning to see some of the programming activities that we see coming to full form once the building comes on line. over the past couple of years, we have initiated an oral history project where we engaged artists and young people to go out into the community and gather the stories of longtime residents, to get their views on the neighborhoods. these stories and insights will be incorporated into an oral history museum that will be within the facility. we continue to engage community in imagining with us what the geneva car barn can mean. its sigca
